OREA Rental Application (Form 410)

OREA Form 410, Rental Application (Residential), is the Ontario Real Estate Association’s standard form that REALTORs® use to collect a prospective tenant’s application for a residential unit.1

What It Is and Isn’t

OREA standard forms are distributed to members through its member forms library.2 In 2004 OREA added the Use and Distribution of Information clause from its listing agreement to Form 410 for privacy reasons.1

The application is not the tenancy agreement. Once an applicant is accepted, most Ontario tenancies must be written on the government standard lease.3

The Form Does Not Set the Rules

What a landlord may ask and weigh comes from the Human Rights Code and its tenant-selection regulation, not from the form: credit references, rental history, credit check consent, income alongside those, and a guarantee.4 Do not decide on a Code ground, and do not ask for information that would reveal one.5

Attach the applicant’s consent to the credit check and reference calls; the privacy regulator expects express agreement for a credit check.6
