Ontario Standard Lease

The Ontario standard lease, formally the Residential Tenancy Agreement (Standard Form of Lease), is the prescribed form most residential tenancy agreements entered into on or after April 30, 2018 must use.1,2

Which Version and Which Tenancies

Agreements signed on or after March 1, 2021 must use the version dated December 2020, in English or French.1 The form is published in the Ontario Central Forms Repository as form 047-2229.3

It does not apply to care homes, mobile home and land lease sites, most social and supportive housing, rent-geared-to-income units and certain other special tenancies.1,4

What It Means When Leasing

  • Both parties must sign on or before the day the tenant is entitled to move in.2
  • Extra terms go in section 15. A term that takes away a right or responsibility under the Act is void, and the guide gives a no-pets clause as an example.4
  • If a landlord does not use the form, the tenant may demand one in writing. If the landlord has not provided it 21 days later, the tenant may withhold up to one month’s rent.2

A rental application such as OREA Form 410 is not the lease. Once an applicant is accepted, the tenancy itself goes on the standard lease.
